Israel court overturns ban on Arab politician

JERUSALEM: Israel's Supreme Court ruled on Sunday an Arab lawmaker could stand in elections, overturning her disqualification by electoral officials over her participation in a Gaza-bound aid flotilla in 2010.

The nine-justice court ruled unanimously Haneen Zoabi "shall be a candidate for the Knesset" in a Jan. 22 poll without giving details of its reasons.

Zoabi drew widespread criticism in Israel for taking part in an international aid flotilla that challenged the Israeli blockade of the Gaza Strip, territory ruled by Hamas Islamists opposed to the existence of the Jewish state.

She was on the Mavi Marmara when Israeli naval commandos raided the Turkish vessel in May 2010, killing nine Turks in clashes with activists on board.

The Central Elections Committee voted on Dec. 19 to disqualify Zoabi, saying she had shown "support for an enemy state or terrorist organisation engaged in armed conflict against Israel".

Zoabi has said she had no role in any of the violence on board the Mavi Marmara and had tried to mediate between the sides during the raid.

Environment Minister Gilad Erdan criticised the ruling saying Zoabi had been involved in "expressing solidarity with our enemies".

Zoabi told Israeli Army Radio the judges had "avoided giving in to the racist right".

The Central Elections committee, which authorises parties' candidates ahead of votes, is chaired by a Supreme Court justice and made up of legislators from a number of political factions.

It has tried several times in the past to disqualify Arab political parties for alleged disloyalty to Israel, only to be overruled by the Supreme Court on appeal.

Zoabi belongs to the tiny Balad party that believes Israel should not be defined as a Jewish state.

Most of the Arabs who make up about 20 percent of the Israeli population are related to or descended from Palestinians who fled or were driven away in a 1948 war over Israel's establishment.

They are full-fledged citizens, though many complain of discrimination.

(AP) ? Hugo Chavez has suffered "new complications" following his cancer surgery in Cuba, his vice president said Sunday, describing the Venezuelan leader's condition as delicate.

Vice President Nicolas Maduro spoke with a solemn expression in a televised address from Havana, saying he had spoken with Chavez and that the president sent greetings to his homeland. Maduro did not give details about the complications, which he said came amid a respiratory infection.

"Several minutes ago we were with President Chavez. We greeted each other and he himself referred to these complications," Maduro said, reading from a prepared statement. The vice president was seated alongside Chavez's eldest daughter, Rosa, and son-in-law Jorge Arreaza, as well as Attorney General Cilia Flores.

Maduro's comments suggest an increasingly difficult fight for the ailing president. The Venezuelan leader has not been seen or heard from since undergoing his fourth cancer-related surgery Dec. 11, and government officials have said he might not return in time for his scheduled Jan. 10 inauguration for a new six-year term.

"The president gave us precise instructions so that, after finishing the visit, we would tell the (Venezuelan) people about his current health condition," Maduro said. "President Chavez's state of health continues to be delicate, with complications that are being attended to, in a process not without risks."

Maduro held up a copy of a newspaper confirming that his message was recorded on Sunday.

"Thanks to his physical and spiritual strength, Comandante Chavez is facing this difficult situation," Maduro said.

Maduro said he had met various times with Chavez's medical team and relatives. He said he would remain in Havana "for the coming hours" but didn't specify how long.

Maduro, who arrived in Havana on Saturday for a sudden and unexpected trip, is the highest-ranking Venezuelan official to see Chavez since the surgery in Cuba, where the president's mentor Fidel Castro has reportedly made regular visits to check on him.

Before flying to Cuba, Maduro said that Energy Minister Hector Navarro would be in charge of government affairs in the meantime.

"The situation does not look good. The fact that Maduro himself would go to Cuba, leaving Hector Navarro in charge only seems understandable if Chavez's health is precarious," said David Smilde, a University of Georgia sociologist and analyst for the Washington Office on Latin America think tank.

Smilde said that Maduro probably made the trip "to be able to talk to Chavez himself and perhaps to talk to the Castros and other Cuban advisers about how to navigate the possibility of Chavez not being able to be sworn in on Jan. 10."

"Mentioning twice in his nationally televised speech that Chavez has suffered new complications only reinforces the appearance that the situation is serious," Smilde said.

Before his operation, Chavez acknowledged he faced risks and designated Maduro as his successor, telling supporters they should vote for the vice president if a new presidential election were necessary.

Chavez said at the time that his cancer had come back despite previous surgeries, chemotherapy and radiation treatment. He has been fighting an undisclosed type of pelvic cancer since June 2011.

Medical experts say that it's common for patients who have undergone major surgeries to suffer respiratory infections and that how a patient fares can vary widely from a quick recovery in a couple of days to a fight for life on a respirator.

Maduro's latest update differed markedly from last Monday, when he had said he received a phone call from the president and that Chavez was up and walking.

The vice president spoke on Sunday below a picture of 19th century independence hero Simon Bolivar, the inspiration of Chavez's leftist Bolivarian Revolution movement.

Maduro expressed faith that Chavez's "immense will to live and the care of the best medical specialists will help our president successfully fight this new battle." He concluded his message saying: "Long live Chavez."

Chavez has been in office since 1999 and was re-elected in October, three months after he had announced that his latest tests showed he was cancer-free.

Opposition politicians have criticized a lack of detailed information about Chavez's condition, and last week repeated their demands for a full medical report.

Information Minister Ernesto Villegas defended the government's handling of the situation, saying during a televised panel discussion on Sunday night that Chavez "has told the truth in his worst moments" throughout his presidency.

Villegas said a government-organized New Year's Eve concert in a downtown Caracas plaza had been canceled, and he urged Venezuelans to pray for Chavez.

Chavez's daughter Maria, who has been with the president since his surgery, said in a message on her Twitter account: "Thank you people of Venezuela. Thank you people of the world. You and your love have always been our greatest strength! God is with us! We love you!"

Allies of the president also responded on Twitter, repeating the phrase: "Chavez lives and will triumph."

Senate leaders work to avoid New Year's "fiscal cliff"

WASHINGTON (Reuters) - Congressional negotiators burrowed into their Capitol offices on Saturday to see if they can stop the economy from falling off of a "fiscal cliff" in just three days when the biggest tax increases ever to hit Americans in one shot are scheduled to begin.

Aides to Senate Majority Leader Harry Reid, a Democrat, and Senate Republican leader Mitch McConnell were expected to work through the day on a possible compromise that would set aside $600 billion in tax increases and across-the-board government spending cuts that are set to kick in next week.

A variety of lower taxes are scheduled to expire on December 31. If allowed to rise, the approximately $500 billion value of the revenue increases would represent a historic hike when taken together.

The combined punch of the tax increases and spending cuts would likely put the U.S. economy into a downward spiral, according to economists' forecasts.

"We're now at the point where, in just a couple days, the law says that every American's tax rates are going up. Every American's paycheck will get a lot smaller. And that would be the wrong thing to do for our economy," President Barack Obama said in his weekly radio and Internet address, which was broadcast on Saturday.

At midday, McConnell walked into his office on the second floor of the Capitol. Asked by waiting journalists if he thought his efforts would be successful, McConnell responded: "I hope so."

A Senate Republican leadership aide said that it might not be known until sometime on Sunday whether these talks bear fruit. That is when leaders are expected to brief their rank-and-file members.

The Senate is scheduled to hold a rare Sunday session beginning at 1 p.m. EST (1800 GMT), but it was not clear whether the chamber would have fiscal cliff legislation to act upon.

Reid and McConnell and their staffs held last-ditch negotiations Friday night and resumed on Saturday with no guarantees that their efforts would pay off. Republicans remained opposed to Obama's demand that households making above $250,000 a year see their income tax rate rise to 39.6 percent, from the current 35 percent, in order to help tame budget deficits.

In recent days, some aides have said that a $400,000 threshold, instead of $250,000, has been discussed as a possible compromise.

PESSIMISTIC OUTLOOK

Democrats and Republicans also are jousting over what to do about inheritance taxes on estates.

Unless Congress acts, the tax is set to jump on January 1 to 55 percent with the first $1 million exempted for individuals. Currently, there is a 35 percent tax and a $5 million exemption.

One Democratic aide was pessimistic that McConnell would come up with a counteroffer that Reid would find acceptable. Such a counteroffer would have to be calibrated in a way that also could attract votes from conservative House Republicans, many of whom have balked at any tax rate increases.

Similarly, a senior House Republican aide on Saturday voiced pessimism about prospects for a deal.

"It's hard to see Reid agreeing to anything that can get the votes of the majority of the majority in the House, thereby allowing a bipartisan accomplishment," the aide said. A "majority of the majority" refers to the 241 Republicans who are in the 435-member House.

The Republican aide placed the blame squarely on Democrats, as many Republican members have done publicly, saying that going off the fiscal cliff is a "policy upside" for them. "Higher taxes, devastating defense cuts. The polls tell them they can win the PR war in January. From their perspective, why stop the cliff dive?"

Democrats, in turn, have publicly accused Republican House Speaker John Boehner of preferring to put off any tough fiscal cliff votes until after a January 3 House election in which he is expected to win another two-year term as speaker.

If McConnell and Reid can manage to reach a deal on inheritance taxes and raising income tax rates on the wealthiest, they likely would throw into the compromise some other fiscal cliff solutions.

Those could include extending an array of other expiring tax breaks, such as one that encourages companies to conduct research and development. Also, Congress wants to prevent a steep pay-cut in January for doctors who treat elderly Medicare patients.

Lawmakers also want to prevent middle-class taxpayers from inadvertently creeping into a higher tax bracket, known as the alternative minimum tax, intended for the wealthiest.

If the Reid-McConnell effort fails, Obama has asked the Senate to hold a vote on Monday on a "basic package" that would stop taxes from going up on the middle class and would extend long-term unemployment benefits that are about to expire. If it passed the Senate, its fate would be in the hands of the Republican-controlled House.

Chester coach Larry Yarbray named Sports Figure of the Year

Chester head boys basketball coach Larry Yarbray's success has come at a time of unprecedented financial hardship for the Chester-Upland School District.

CHESTER ? Larry Yarbray had one dream and one obligation, never in that order. So before he would ever begin his career as a college basketball coach, he first would try to help kids. Two of them. That?s all. Just two.

?I had two brothers, one was 10 years younger than me, the other 10 years younger than him,? Yarbray, the basketball coach at Chester High was saying the other day, during a break in practice. ?My mother, Margo Yarbray, was a single mom. So you try to be around so you can be that male figure, somebody that the kids can talk to and just make sure that everybody is OK.?

His plan was to do that for a while, then become a volunteer assistant coach at the college level, most likely at his alma mater, Coppin State, and then to maneuver deeper into the industry. Too soon, though, he learned that plans can change ? quickly.

?My youngest brother, Jeremy, was murdered,? he said. ?It was in Dover, Delaware. He was 18 and he?d gotten caught up in doing the wrong things. He took the path where he didn?t want to go to school. He wanted to get into being a rapper or doing some other things, like listening to his peers. It was sad. He was struggling for ends to meet and struggling to have money in his pocket. He turned the wrong corner and he ended up getting caught up selling drugs. Some guy tried to rob him and shot him and killed him.?

It was just about then that Yarbray figured his calling was not necessarily to recruit basketball players to colleges, but to make certain they survived high school. So he returned to his hometown, Chester, and began working with the Clippers? basketball program, eventually succeeding Fred Pickett as the head coach. There, he has won. He has won games. He has won two state championships. He has won the satisfaction of helping many, many more than two young men toward life?s successes.

And since Yarbray, 42, did all of that in 2012, while not only coaching Chester to its only undefeated season but doing so as the very future of the school was being threatened, he has won Delaware County?s Sports Figure of the Year honor, as presented by the Daily Times sports department.

Based on the end-of-the-year Sports Illustrated model, the honor goes to that individual, entity or concept that best brought positive attention to Delaware County in the previous 365 days. Yarbray is the second Chester basketball coach to be so recognized since 2008, when Pickett earned the honor. Last year, the award went to the Philadelphia Union, for making a different, though vital, sports impact in Chester.

?Larry has taught our kids about the game and about hard work,? said Randy Leggette, the Chester athletic director. ?It?s something I?m proud to see.?

In Yarbray?s fourth season as their head coach, the Clippers went 32-0, ran a two-year winning streak to 58 games and won their second consecutive PIAA Class AAAA state championship with a 59-33 victory over Lower Merion. As impressive as the numbers, though, was the challenge. For amid that perfection, a program legend, former coach Alonzo Lewis, was accidentally struck by an automobile and killed while crossing a street. And as Chester was gaining national status, there was a threat to the school ? a threat that remains, as the Chester-Upland School District has come under state receivership.

To the players, that trap of finance and politics may mean little. But to their head coach, who had come to understand how suddenly anything can vanish, it would become a season-long point of emphasis. Continued...

?It helped us to be focused and not take things for granted,? Yarbray said. ?I truly believe that you can?t take anything for granted in life. It was a special season that we had last year. If we had lost focus and started focusing on what was going on with the school, then the kids might not really understand that there is the potential that the school may close and they might be on the last team to play at Chester High. I said, ?What do you want to be remembered as?? You?ve got to take that. And sometimes, you take it as a positive and you move forward with it. But the reality is, one day the school might close. I still put it at 50-50.

?It?s sad to say you are right back in that same situation this year. They gave the school to the state in receivership and hopefully they can come up with a plan that will work. And hopefully the people around here can support that plan to make it work. But you?ve got to come out and support your children. And I believe everything starts at home. You teach your kids at home. You follow them. You monitor them. You mentor them and you do what you are supposed to do, making sure they are doing their homework and following up on it. Then, they have a chance to be successful. If you don?t, then people are going to fall through the cracks. That?s when people make excuses. They put all the blame on the school. But it takes a whole community to raise a child.?

In Chester, it long has taken a city to raise one of the most enduring high school basketball programs in the nation, eight times the state champion with the talent and the expectations to make it nine in 2013. But Yarbray has taken that mission and has lived it, spending many of his weekends watching the youth programs in the city.

?I get to go see my future,? he said. ?I get to see the young kids who potentially are going to play for me one day. And you almost start building relationships then. All the kids in the Chester Biddy program are welcome to come to our games. We let them come through the doors. They go in the locker room with us before the game, during the game, after the game, so they can get a feel.

?You want to start that process. You want these kids that they look up to to reach back and say, ?Listen, you can make it. If you do the right thing and come through Chester High, you still have the opportunity.? I went to Chester High. I graduated. I went to college and was fortunate to come back as coach.?

He came back as the head coach, knowing the rules: Win a state championship, or be heckled from the stands ? the Chester stands. So after going 24-5 in his first season, he needed to rebuild and worked with a young nucleus through a 16-11 season that did not fast-break past the skeptics. For while he was once a classic Chester guard, he was trying to replace the legendary Pickett, who had replaced the legendary Lewis, Yarbray?s own high school coach.

?They were big shoes to fill,? Yarbray said. ?But I know how it is. Even this year, we lost two games in Florida and you can hear the naysayers and the people talking. They forget about the wins rather quick. We won 61 straight. You would think that would give you a trump card in your back pocket or something. But there are no days off in this program. And me, myself, I expect the same thing.?

The experience of the 16-11 team helped to yield the consecutive state championships that followed, and then such a growth in the program that this season, it twice will appear on an ESPN network.

But even if the Clippers win another championship, Yarbray will be back to work, trying to keep the program where its supporters have come to understand it belongs.

As the executive director of the Boys and Girls Club of Chester, Yarbray has deepened his community commitment. He still has visions of a college coaching career, and seems a little surprised that the call has yet to come. So he remains at Chester, where, he claims, he has not received a paycheck this season. ?Why not?? he said. ?I don?t know. But to me, it?s about the kids.?

Which is exactly how it started.

?My other brother, Lamar, is doing real well,? Yarbray said. ?He went to Williamson Trade School and is very successful in power-plant management. So I guess I went 50 percent. But that?s what brought me back here.?

The father of Larry Jr., 13, and daughter Micah, 11, does what he can, winning games, then ducking skeptics and other challenges.

?You try to tell the kids to enjoy the moment,? he said. ?You can?t take anything for granted in life because you never know what may happen in life. But when you?re on the basketball court, you have to play as hard as you can, try to win and do what you have to do to keep it moving.

Officers' 'gut feeling' leads to missing LA tot

When two University of Kentucky officers noticed a toddler in nothing but a short-sleeved onesie being pushed in a stroller on a windy, frigid night, they had a ?gut feeling? that something was amiss, said University of Kentucky Police Chief Joe Monroe.

That hunch led to the discovery of a 17-month-old girl who was reported abducted from Los Angeles, possibly by a family member, on Oct. 15.

A woman who police believe is the toddler?s grandmother was taking the child ? without shoes, gloves, hat or anything to protect her face ? on a stroll through the University of Kentucky campus Thursday night, when the temperature had dropped to 29 degrees and the wind was blowing about five miles per hour, Monroe told NBC Los Angeles.?

Campus police officers Jennifer Ockerman and Emily Smith spotted Maria Baltierra-Dejesus, 62, pushing Alouette Day-Moreno-Baltierra in a stroller through a campus parking lot.

"This is an example of where the responding officers followed a gut feeling that something just wasn?t right with the situation," Monroe said in a press release.

Baltierra-Dejesus, who lives in New York, was booked in Kentucky on suspicion of endangering the welfare of a minor and custodial interference. She was receiving medical treatment Friday night, though Monroe would not say why.

Monroe said it was not clear where the girl?s parents are, and that she apparently belonged to the State of California.

For now, Alouette is in custody of the Kentucky Child Protective Services, which is working with LAPD and the FBI to return her to California, Monroe said.

Only one out of 27 measures of use, quality, and survival showed any significant advantage to tumor boards after adjustment for multiple comparisons, Nancy L. Keating, MD, MPH, of Harvard and the Brigham and Women's Hospital in Boston, and colleagues found.

Several measures of recommended care actually went in the wrong direction with cancer-specific tumor boards, such as lower use of white blood cell growth factors with cyclophosphamide, adriamycin, vincristine, and prednisone (CHOP) in diffuse large B-cell non-Hodgkin lymphoma, they reported online in the Journal of the National Cancer Institute.

While these group meetings are designed to better coordinate care among specialists and ultimately improve its quality, it's possible they just don't help, the group noted.

But "it might also mean that tumor boards are only as good as their structural and functional components and the expertise of the participants, and because tumor boards likely vary in their efficacy depending on these factors, measuring only the presence of a tumor board may not be sufficient to understand their effects," they wrote.

That should come as no surprise to anyone who has ever been part of a team huddle, agreed Douglas Blayney, MD, of the Stanford Cancer Institute in Stanford, Calif., agreed in an accompanying editorial.

"Execution of the plan is how we get to good outcomes regardless of the brilliance of the plan, the talent of the team, or the difficulty of the task," he wrote.

Although the study's results are disappointing, tumor boards have too long a history for them to go away, Blayney noted.

Instead, he suggested giving the boards feedback if their recommendations were followed, and why or why not, as a tool to improve them.

The researchers surveyed VA medical centers on their use of tumor boards and linked the answers to cancer registry and administrative data for patients with colorectal, lung, prostate, hematologic, and breast cancers diagnosed from 2001 to 2004 and followed through 2005.

Three-quarters of the centers (103 of 138) said they had at least one tumor board.

Of the 41% that had multiple tumor boards, all had one for lung cancer specifically, 95% had one for colorectal cancer, and 83% had a prostate cancer-specific tumor board (83%).

These boards almost always included medical oncologists, pathologists, and surgeons. Other participants were radiation oncologists (81%), radiologists (76%), social workers (31%), palliative care specialists (31%), and nutritionists (21%).

In the unadjusted analyses, seven of the 27 measures of care assessed were significantly linked to the presence of any tumor board:

  • Stage I/II lung cancer not treated with curative surgery was more likely to get radiation if treated at a general tumor board compared with no tumor board or a lung cancer-specific tumor board.
  • Stage IIIA lung cancer not treated surgically was more likely to get chemotherapy and radiation at centers with a general tumor board or a lung cancer?specific tumor board versus no tumor board.
  • Limited-stage small-cell lung cancer was more likely to receive chemotherapy and radiation at centers with a general tumor board or a lung cancer-specific tumor board versus none.
  • Metastatic prostate cancer was more likely to be treated with an oral antiandrogen before gonadotropin-releasing hormone agonist therapy if seen at a center with a prostate cancer-specific or general tumor board versus none.
  • Non-Hodgkin lymphoma was more likely to be treated with the CHOP chemotherapy at centers with no tumor board, or with a hematologic cancer-specific tumor board, versus one with a general tumor board.
  • CHOP chemotherapy was more likely to be given with white blood cell growth factor support at centers with a general tumor board or no tumor board versus with a hematologic cancer-specific tumor board.
  • More than one emergency visit in the last 30 days of life was more likely without any tumor board, or with a tumor board that had a palliative care specialist, versus with a tumor board without a palliative specialist.

After multivariate adjustment for patient sociodemographic and clinical characteristics, the only significant association was that limited-stage small-cell lung cancer patients seen at VA centers with a general or a lung cancer-specific tumor board were still more likely to be treated with chemotherapy and radiation than when seen at centers without any tumor board (P<0.00185).

A possible explanation is that information about some types of recommended care are widely enough known without tumor boards, particularly in an integrated delivery system where care may be better coordinated than in other settings, Keating's group suggested.

Study limitations were a lack of data on format or frequency of tumor board meetings and whether the individual patients whose outcomes were analyzed were discussed by the tumor boards.

The analysis was funded by the Department of Veterans Affairs through the Office of Policy and Planning.

The study authors and Blayney provided no information on conflicts of interest.

Italy's confused election gets another twist

ROME (AP) ? Italy's confused election campaign took another twist Friday with the country's respected national anti-Mafia prosecutor joining ranks with the center-left Democratic Party, a big-name boost for a party that is already leading in the polls ahead of the February vote.

A day earlier, Premier Mario Monti got an even bigger endorsement for his potential candidacy from the Vatican newspaper after winning a not-so-subtle thumbs up from the pope himself on Christmas Day.

Almost left behind in the jockeying was Italy's most colorful politician, Silvio Berlusconi, who was on the front pages of Italy's leading daily Friday for an entirely other reason. Corriere della Sera revealed details of his divorce settlement with his second wife Veronica Lario, showing that he must pay her ?3 million ($4 million) a month. He gets to keep the house, however.

Italians vote Feb. 24-25 in general elections after a yearlong experiment with Monti's technocratic government, appointed to help steer Italy through the eurozone's debt crisis. Monti took the place of Berlusconi, who was forced to resign in November 2011 after international markets lost faith in his ability to enact necessary reforms.

Monti has hedged his political intentions, saying he won't run but would be open to leading a new government if like-minded politicians who backed his 25-page political platform asked him. He met Friday with centrist leaders who are his main supporters but who are only expected to win a small chunk of the popular vote.

Leading in the projections with some 30 percent of the vote is the Democratic Party, which proudly presented prosecutor Pietro Grasso at party headquarters in Rome for his political debut. Grasso choked up as he recounted how his hand trembled a few days ago when he wrote the letter to Italy's order of magistrates seeking to end his 43-year career fighting the mob.

He explained his "radical" decision to run for an as yet unidentified office as wanting to leave a better country for his grandson. Sounding more like a potential justice minister than mere parliamentary candidate, Grasso said he had a vision of Italy to "be at the service of a country that has reached the maximum of confusion."

Pier Luigi Bersani, the Democratic Party's candidate for premier, looked pleased at having brought into his party a figure who is respected on both the left and right. Grasso didn't say exactly what he was running for, only that he had asked not to run in his native Sicily, where he said his investigations against the Cosa Nostra had "left their mark."

Bersani has said he wants to bring morality back to Italy and Italian politics ? a clear reference to the sex scandals and legal woes that helped bring down Berlusconi.

He was asked about the Vatican newspaper's endorsement of Monti, a practicing Catholic who has enjoyed the esteem of Pope Benedict XVI. Praising Monti, L'Osservatore Romano said the economist clearly wanted to "recover the highest and most noble sense of politics" for the common good.

Bersani said he had long considered politics to be noble.

Cardinal Angelo Bagnasco, the head of Italy's bishops conference, on Friday said Monti was recognized both at home and abroad for his "honesty and capability."

Support from the Vatican and the Italian Catholic Church, both influential in the country's society, is considered crucial for any Italian government.

The Vatican made clear by the end of Berlusconi's last term that it was tired of his scandalous lifestyle. His wife said she was divorcing him because of his fondness for younger women. Separately, the media mogul is on trial in Milan for allegedly paying for sex with an underage woman and trying to use his office while premier to cover it up, charges he has denied.

Berlusconi, 76, is currently dating a woman nearly 50 years his junior. After waffling for months, he seems very much in campaign mode, though his center-right People of Freedom party trails in the polls.

(AP) ? U.S. Sen. Michael Crapo, the Idaho Republican arrested on suspicion of drunken driving, doesn't plan to fight the charges when he appears in court in January, a spokesman said Friday.

Meanwhile, results from a secondary blood alcohol test performed at the jail show the conservative three-term senator registered a higher level about an hour after being arrested than when he was first tested by the police officer who stopped him.

Police have said Crapo registered a blood alcohol level of 0.11 percent when he was pulled over early Sunday in the Washington suburb of Alexandria, Va., after running a red light. But a secondary test performed after Crapo was brought to the jailhouse ? the one that will be used in court ? registered at 0.14, nearly twice the legal limit, according to a law enforcement official with knowledge of the arrest. The official wasn't authorized to release information publicly and spoke on condition of anonymity.

"He does not plan to contest the charges," said Crapo spokesman Lindsay Nothern, adding that Crapo has consulted with a local Virginia attorney ahead of his Jan. 4 court hearing.

Nothern confirmed there had been a discrepancy in the blood alcohol tests, but said he was uncertain why they differed.

A blood alcohol level of 0.14 means Crapo tested 1/100 of a percentage point below the level that would have mandated jail time under Virginia law. The legal limit in Virginia, which has strict drunken driving laws, is 0.08 percent.

Crapo has apologized and taken responsibility for the incident in a statement, but he hasn't spoken publicly about the arrest. Crapo returned to Washington from Idaho on Wednesday as lawmakers pursue a solution to the looming fiscal cliff, but he wasn't immediately available to comment Friday.

A number of factors could explain the discrepancy between the preliminary breathalyzer test, performed on the street when Crapo was pulled over shortly after midnight, and the jailhouse test, conducted just before 2 a.m. The higher level at the jailhouse could indicate Crapo was drinking shortly before getting behind the wheel and his body was still absorbing the alcohol. But another possible explanation is that blood alcohol testing simply isn't a perfect science, said Michael Hlastala, a breath testing expert and former physiology professor at the University of Washington.

"It could be consistent with rising blood alcohol levels," Hlastala said. "But it just depends on the way the person was breathing, and other factors."

Alexandria police say Crapo was alone in his vehicle when he ran a red light, was pulled over and failed field sobriety tests. He was taken to the Alexandria jail and released on an unsecured $1,000 bond about 5 a.m. Sunday. Crapo is scheduled to appear in court on Jan. 4 ? the day after the start of the next Congress. Crapo was handily re-elected in 2010 and won't have to run again until 2016.

It's still not clear where Crapo was coming from when he was arrested, and the senator hasn't explained the circumstances of the arrest. Court records show Crapo residing in Southeast Washington, a short drive over the Potomac River from the historic suburb where he was arrested.

The 61-year-old's arrest two days before Christmas stunned colleagues and constituents alike, not only because of his squeaky-clean image but also because the senator, a Mormon, had said previously he abstains from alcohol, in accordance with his church's practices.

Many of Crapo's Republican colleagues, including Sen. Jim Risch, Idaho's senior senator, have come to his defense, suggesting Crapo can overcome the indiscretion and remain a viable leader. Crapo's home-state newspaper, the Idaho Statesman, ran an editorial with the headline: "We can all learn from Sen. Crapo's mistake."

2013 Best Time For Investing In Real Estate | American Apartment ...

If you read the mainstream media, the forecast for real estate seems bleak. This is especially the case in hard hit states like California, Florida, Arizona, Nevada, Illinois, Ohio, Michigan and New York.

In 2010 and 2011, one in every 17 households in Arizona received a foreclosure notice. In Florida one in every 18 houses went into foreclosure last year. Many experts are predicting that lenders will take back more homes in 2012 than in any other previous year since the foreclosure crisis began.

All of this bad news in the media gives the average reader the impression that now is not a great time to be buying real estate.

After all, why would you invest in real estate if there is so much negative news?

Negative news has a negative effect on buyers, forcing them to sit on the sidelines while they wait for better news. Adding to the negative news is the fact that over the past few years it has been very difficult for home buyers to get approved for a mortgage. This is yet another reason why potential home buyers might sit on the side lines and wait for the situation to improve.

Foreign Cash Buyers Snapping Up Deals

By the end of 2010 and throughout 2011 more and more cash buyers had entered the market looking for bargains. Over the past year many of our buyers have been foreign buyers and we have been fielding phone calls in our office from Canadian, European, South American, Russian and even Chinese investors. It seems that these foreign investors have figured out something that many local investors have not. These foreigners know just like I do that real estate is a screaming buy right now. Real estate is such an amazing bargain right now that I coined a phrase to characterize the current state of the real estate market. This is the quote that I use: ?This will be the best time in your lifetime to buy real estate?. Or expressed another way, between now and the day that you die, you will never get another opportunity to buy real estate at such cheap prices. Adjusted for inflation housing prices are cheaper than they have ever been since the Great Depression.

The prices that some of these bank owned properties are selling for is such an incredible opportunity for cash investors (you cannot buy bank owned properties with a mortgage). Many cash buyers are scooping these properties up as fast as the banks can list them. The banks know this and very wisely are listing them slowly to maintain demand. Most of the action that I see is in the affordable lower priced homes. These are the types of homes that make great rental properties for landlords and also make great properties for fixing and flipping to first time home buyers.

FHA Loans & First Time Home Buyers Rising

FHA loans are getting approved and many first time home buyers are buying their first home instead of renting which means there is a substantial pool of buyers for these entry level homes. In South Florida most of the homes that we sell are priced at less than $100,000. Potential landlords are especially attracted to houses in the $60,000 to $90,000 price range since the cash flow opportunities are tremendous. One example is a student of mine that purchased a house for $37,000, spent $12,000 repairing the house and then rented the house to a section 8 tenant for $1,250 per month.

Where Are The Best Deals?

We haven?t seen that kind of cash flow in real estate for at least 30 years if not longer. I speak to my real estate associates in California, New York, Arizona and Nevada and they all tell me that the situation is the same in their states. Affordably priced single family homes are where the action is right now in the bank owned property market.

Low priced homes will move first because these homes have the most buyers. Potential buyers for these homes are landlords, retirees and real estate investors looking to fix and flip properties for a profit. For the first time in many years homes are finally priced affordably. First time homebuyers can purchase a home with an FHA mortgage and have a monthly mortgage payment equivalent to what they were previously paying in rent. In many cases their mortgage payment can be lower than what they would pay in rent. And these first time home buyers only need to put down 3 1/2 percent for an FHA mortgage which means that anyone with decent credit that is renting could probably afford to buy the home that they are currently renting if it is an affordably priced home.

Foreign Buyers Focusing On Rehabbing & Flipping

There is also a tremendous opportunity in flipping properties for a profit. Investors can purchase a bank owned home for $70,000, spend $15,000 repairing it and flip it for a profit of $25,000 or more. That is why so many foreign investors are trying to buy these properties. We have investors that are purchasing multiple properties every single month for the purposes of fixing and flipping these properties for a profit. These investors can buy 20, 30 or even 40 homes per year to fix and flip.

If you are a cash investor your return on fixing and flipping houses is much higher than any other type of investment that you currently have. For this reason many of our investors are liquidating real estate in other countries and even their stock portfolios in order to invest in single family houses that can be flipped for a profit. The returns that are being made right now in this market cannot be found anywhere else. And this is especially true if you live in a country where you are worried about the stability of your currency or economy like many countries in Europe right now.

Luxury & High End Homes Sputter

Houses that sell at higher prices still suffer challenges because so many buyers cannot qualify for a mortgage. As long as banks are reluctant to lend, it will be hard for this market to move significantly. However there is still opportunity for cash buyers to fix and flip these houses for even larger profits. The key is to find a buyer that can get approved for a mortgage which is still very challenging. Over time, as banks begin lending again this market too will improve and we are already seeing signs of improvement in this market.

2013 Foreclosure Shadow Inventory

Many experts are predicting that lenders will take back more homes in 2013 than in any other previous year since the foreclosure crisis began. Which brings me to what REO agents and asset managers call ?shadow inventory? ? homes that are in foreclosure that have not yet been listed for sale by the banks. Since these properties theoretically will eventually end up being listed for sale on the multiple listing service (MLS) the inventory is considered shadow inventory because everyone assumes that it is coming but yet you cannot see the inventory since it has not yet been listed on the market.

2013 Great Time to Invest In Real Estate

In summary, now is a great time to be buying real estate. This is a good time to be investing in real estate regardless of whether you are a first time home buyer looking for your first home at a great price, a real estate investor looking to fix and flip a property or a potential landlord looking to buy real estate and hold rental property for the long term for cash flow. Many retirees are taking advantage of the discount in prices to buy themselves their retirement home at a fraction of what they would have paid just 5 years ago. Returns for landlords on rental properties are the best they have ever been. If you are looking to buy rental properties now is the time to buy.

Do not wait for the media to start painting a rosy picture about the real estate market before you buy. 2012 or 2013 might just be the year when the shadow inventory hits the market. This could be the year which in hindsight will turn out to be the unprecedented real estate buying opportunity of your lifetime. You must take advantage of this and start buying real estate right now while you can still get great deals at great prices. Remember that prices have already started moving up.

When there are no more sellers left to sell and when all of the banks are finally done liquidating their properties at bargain prices then prices can only go one way. And that way is up.

Over the fiscal cliff: Soft or hard landing?

(AP) ? Efforts to save the nation from going over a year-end "fiscal cliff" were still in disarray as lawmakers returned to the Capitol to confront the tax-and-spend crisis. A tone-setting quotation was Democratic Sen. Harry Reid's assertion that the House under Republican Speaker John Boehner had been "operating with a dictatorship."

President Barack Obama flew back to Washington from Hawaii after telephoning congressional leaders from his Christmas vacation perch. Once back, he set up a meeting with leaders of both parties at the White House late Friday to make a fresh attempt to find a solution before Monday night's deadline.

A look at why it's so hard for Republicans and Democrats to compromise on urgent matters of taxes and spending, and what happens if they fail to meet their deadline:

NEW YEAR'S HEADACHE

Partly by fate, partly by design, some scary fiscal forces come together at the start of 2013 unless Congress and Obama act to stop them. They include:

? Some $536 billion in tax increases, touching nearly all Americans, because various federal tax cuts and breaks expire at year's end.

? About $110 billion in spending cuts divided equally between the military and most other federal departments. That's about 8 percent of their annual budgets, 9 percent for the Pentagon.

Hitting the national economy with that double whammy of tax increases and spending cuts is what's called going over the "fiscal cliff." If allowed to unfold over 2013, it would lead to recession, a big jump in unemployment and financial market turmoil, economists predict.

WHAT IF THEY MISS THE DEADLINE?

If New Year's Day arrives without a deal, the nation shouldn't plunge onto the shoals of recession immediately. There still might be time to engineer a soft landing.

So long as lawmakers and the president appear to be working toward agreement, the tax hikes and spending cuts could mostly be held at bay for a few weeks. Then they could be repealed retroactively once a deal was reached.

The big wild card is the stock market and the nation's financial confidence: Would traders start to panic if Washington appeared unable to reach accord? Would worried consumers and businesses sharply reduce their spending? In what could be a preview, stock prices around the world dropped Friday after House Republican leaders' plan for addressing the fiscal cliff collapsed.

Federal Reserve Chairman Ben Bernanke has warned lawmakers that the economy is already suffering from the uncertainty and they shouldn't risk making it worse by blowing past their deadline.

WHAT IF THEY NEVER AGREE?

If negotiations between Obama and Congress collapse completely, 2013 looks like a rocky year.

Taxes would jump $2,400 on average for families with incomes of $50,000 to $75,000, according to a study by the non-partisan Tax Policy Center. Because consumers would get less of their paychecks to spend, businesses and jobs would suffer.

At the same time, Americans would feel cuts in government services; some federal workers would be furloughed or laid off, and companies would lose government business. The nation would lose up to 3.4 million jobs, the Congressional Budget Office predicts.

"The consequences of that would be felt by everybody," Bernanke says.

THE TAXES

Much of the disagreement surrounds the George W. Bush-era income tax cuts, and whether those rates should be allowed to rise for the nation's wealthiest taxpayers. Both political parties say they want to protect the middle class from tax increases.

Several tax breaks begun in 2009 to stimulate the economy by aiding low- and middle-income families are also set to expire Jan. 1. The alternative minimum tax would expand to catch 28 million more taxpayers, with an average increase of $3,700 a year. Taxes on investments would rise, too. More deaths would be covered by the federal estate tax, and the rate climbs from 35 percent to 55 percent. Some corporate tax breaks would end.

The temporary Social Security payroll tax cut also is due to expire. That tax break for most Americans seems likely to end even if a fiscal cliff deal is reached, now that Obama has backed down from his call to prolong it as an economic stimulus.

THE SPENDING

If the nation goes over the fiscal cliff, budget cuts of 8 percent or 9 percent would hit most of the federal government, touching all sorts of things from agriculture to law enforcement and the military to weather forecasting. A few areas, such as Social Security benefits, Veterans Affairs and some programs for the poor, are exempt.

THERE'S MORE AT STAKE

All sorts of stuff could get wrapped up in the fiscal cliff deal-making. A sampling:

? Some 2 million jobless Americans may lose their federal unemployment aid. Obama wants to continue the benefits extension as part of the deal; Republicans say it's too costly.

? Social Security recipients might see their checks grow more slowly. As part of a possible deal, Obama and Republican leaders want to change the way cost-of-living adjustments are calculated, which would mean smaller checks over the years for retirees who get Social Security, veterans' benefits or government pensions.

? The price of milk could double. If Congress doesn't provide a fix for expiring dairy price supports before Jan. 1, milk-drinking families could feel the pinch. One scenario is to attach a farm bill extension to the fiscal cliff legislation ? if a compromise is reached in time.

? Millions of taxpayers who want to file their 2012 returns before mid-March will be held up while they wait to see if Congress comes through with a deal to stop the alternative minimum tax from hitting more people.

CALL THE WHOLE THING OFF?

In theory, Congress and Obama could just say no to the fiscal cliff, by extending all the tax cuts and overturning the automatic spending reductions in current law. But both Republicans and Democrats agree it's time to take steps to put the nation on a path away from a future of crippling debt.

Indeed, the automatic spending cuts set for January were created as a last-ditch effort to force Congress to deal with the debt problem.

If Washington bypassed the fiscal cliff, the next crisis would be just around the corner, in late February or early March, when the government reaches a $16.4 trillion ceiling on the amount of money it can borrow.

Boehner says Republicans won't go along with raising the limit on government borrowing unless the increase is matched by spending cuts to help attack the long-term debt problem. Failing to raise the debt ceiling could lead to a first-ever U.S. default that would roil the financial markets and shake worldwide confidence in the United States.

To avoid that scenario, Obama and Boehner are trying to wrap a debt limit agreement into the fiscal cliff negotiations.

SO WHAT'S THE HOLDUP?

They're at loggerheads over some big questions.

Obama says any deal must include higher taxes for the wealthiest Americans. Many House Republicans oppose raising anyone's tax rates. Boehner tried to get the House to vote for higher taxes only on incomes above $1 million but dropped the effort when it became clear he didn't have the votes.

Republicans also insist on deeper spending cuts than Democrats want to make. And they want to bring the nation's long-term debt under control by significantly curtailing the growth of Medicare, Medicaid and Social Security ? changes that many Democrats oppose.

Obama, meanwhile, wants more temporary economic "stimulus" spending to help speed up a sluggish recovery. Republicans say the nation can't afford it.

IT'S NOT JUST WASHINGTON

Seems like they could just make nice, shake hands and split their differences, right?

But there's a reason neither side wants to give ground. The two parties represent a divided and inconsistent America. True, Obama just won re-election. But voters also chose a Republican majority in the House.

Republican and Democrats alike say they are doing what the voters back home want.

Neither side has a clear advantage in public opinion. In an Associated Press-GfK poll, 43 percent said they trust the Democrats more to manage the federal budget deficit and 40 percent preferred the Republicans. There's a similar split on who's more trusted with taxes.

About half of Americans support higher taxes for the wealthy, the poll says, and about 10 percent want tax increases all around. Still, almost half say cutting government services, not raising taxes, should be the main focus of lawmakers as they try to balance the budget.

When asked about specific budget cuts being discussed in Washington, few Americans express support for them.

THE COUNTDOWN

Time for deal-making is short, thanks to the holiday and congressional calendars. Some key dates for averting the fiscal cliff:

? Lawmakers didn't begin returning to the Capitol until Thursday, leaving less than a week to vote on a compromise before year's end.

? Obama returned Thursday from his Christmas vacation in Hawaii. The president asked congressional leaders to the White House Friday to try to resolve the fiscal cliff.

? If lawmakers reach Dec. 31 without a deal, some economists worry that the financial markets might swoon.

? The current Congress is in session only through noon Eastern time on Jan. 3. After that, a newly elected Congress with 13 new senators and 82 new House members would inherit the problem.

Champagne loses fizz in Europe after tough year

PARIS (AP) ? Europeans are finding fewer reasons to pop open a bottle of Champagne as another year of economic troubles and high unemployment saps the region's appetite for the finer things. But while the latest industry figures show that sales might be on the wane in Europe, other markets, particularly Japan and the United States, are developing a taste for a glass of bubbly.

In what is certain to be bad news for the vineyards, France ? Champagne's largest market ? is drinking fewer bottles. Sales of Champagne for the country were down 4.9 percent, and 5 percent elsewhere in the 27-country European Union, in the first nine months of 2012 compared with the same period in 2011, according to CIVC, the national association of growers and producers of the wine.

Nineteen months of rising unemployment and growing fears that the worst is yet to come have taken their toll on France ? nearly seven in 10 French are worried about their country's future, according to a recent poll.

"The French are pessimist by nature," said Antoine Chiquet, whose family has been producing Champagne for three generations and wine for eight. "We had a difficult election, we're in an economy where Europe's foundations are being questioned."

Nonetheless, the country managed to drink 175.7 million bottles of Champagne from Nov. 1 2011 to Oct. 31 2012, according to CIVC ? enough for nearly 3 bottles a year for every man, woman and child but about 10 million bottles fewer than the previous year. In contrast, the U.S. consumed enough sparkling wine for about 1.5 bottles per person in 2010, the latest figures available from the California-based Wine Institute.

But while the news out of France and Europe is bad, CIVC figures show export sales were up 3 percent in the first three quarters of the year. Top markets included the U.S., Japan and, to a lesser extent, China. A total of 19.4 million bottles of Champagne went to the United States and 7.9 million went to Japan ? the only two countries outside Europe in the top seven export markets.

Takayasu Ogata, a Tokyo-based sommelier, said Champagne and sparkling wine consumption is climbing in Japan at a time when overall wine demand peaked about 2000. According to the French figures, Champagne consumption alone was up nearly 7 percent over a year there.

"Both individuals and restaurants are taking to Champagnes with personality, including those that are from small makers but taste good," he said.

Lower price is another reason. Gone are the days when a bottle of Moet & Chandon went for 5,000 yen ($60) or more in Japan. These days, you can get real Champagne for as little as 2,000 yen ($25).

Of course, for those with rich tastes and a budget to match there are still lots of expensive Champagnes, selling for 10 times that, according to Ogata, who works at Venture Republic, an Internet retailer, and is in charge of wines.

Beer remains the drink of choice for many "salarymen," but younger people and women are taking a liking to Champagne, Ogata says.

"It's about the bubble ? a sense of gorgeousness," he said in a telephone interview. "There's that thrill to opening up a bottle of Champagne."

China is also emerging as a potentially strong market for a glass of fizz, although the numbers remain small. In 2011, the latest figures available, it ranked 19th in export markets for Champagne, apparently because consumers are less discriminating about precise origins. According to an EU ruling, only sparkling wine made in a particular region in northeast France is allowed to carry the name Champagne. The United States makes some exceptions, as long as the labeling is clear.

"People enjoy the 'boom' moment of opening sparkling wine. It is fun. It offers a more festive atmosphere and it tastes good," said said Yu Ming, a 29-year-old who operated a bar in Beijing's Sanlitun nightlife district until 2010. In China, he added, "people call all sparkling wine Champagne. They don't care where it is from or whether the fermentation is inside the bottle."

The sales manager at the BHG supermarket in a luxury shopping mall in Beijing confirmed that Champagne budgets are largely out of reach in China, saying most customers at the chic store will instead choose sparkling wine: "The most expensive Champagne is 7,800 yuan ($1,250) a bottle at my store, but the most expensive sparkling wine is only 268 yuan ($43)," said the manager, who gave his surname, Hou.

Chiquet, whose label Gaston Chiquet produces about 200,000 bottles a year, said France and Europe generally will remain the most important markets for Champagne. But for the numbers to climb again "we'll have to rediscover optimism."

"Champagne remains a drink for celebrating the big events of life," said Chiquet. "Happily for sales, at the end of the year, the French rely on tradition. Still, we're not going to catch up. Unfortunately, what's lost already is lost."

Hey Friends!

I hope you all had a wonderful Christmas!! Can you believe it's time to take down the tree & get ready for the new year? We usually wait until after the new year to take down all of our decorations, but for whatever reason, I'm thinking about parting with them sooner this year! I'm anxious to put everything away & get my house back to normal. Anyone else with me?
